ARTICLE XII

LIMITATION OF LIABILITY

Notwithstanding the Association's duty to maintain and repair the Common Properties, the Association shall not be liable for injury or damage caused by a latent condition in the Common Properties, nor for injury or damage caused by the elements or by Members or other persons.
